This section also addresses the protection of the rights of employees on the transfer of a business, which are covered by the European Communities (Protection of Employees on Transfer of Undertakings) Regulations 2003 (S.I. No. 131 of 2003). The Code of Practice for Determining the Self-employment or Employment Status of Individuals, updated in 2007, outlines the factors to distinguish a contract of employment from a contract for services.
